Refusing sample case is adjourned
A man accused of failing to give a sample when suspected of driving over the limit has had his case adjourned.
Edward Murphy (38) of 13 Brooklands, Marlton Road, Wicklow, appeared in Bray District Court last Thursday.The court heard that on Saturday, September 10, 2016, Murphy was driving in the wrong direction on Meath Road in Bray at 2.44 a.m. and was veering from side to side, narrowly avoiding colliding with other cars.
The court heard that in the garda station that night, he was stumbling, mumbling his words, and refused to give a sample.
The court heard that Murphy ‘point blank’ refused to provide a specimen of breath.
‘No evidence was given that an explanation for the arrest was given in ordinary language,’ said a barrister for the defence. The judge said he would listen to the recording and adjourn that matter. Murphy was also charged with dangerous driving for his manner of driving on Meath Road. Judge David Kennedy said that he would convict, and sentence him along with the other matter.
The case was adjourned to September 28.
