Unin­sured man said brother was driv­ing

A MAN who claimed his brother was driv­ing was con­victed last week of hav­ing no in­surance.

Farid Boudakhan (37), with ad­dresses in Car­low and En­niskerry, ap­peared in Bray Dis­trict Court last Thurs­day, where he was dis­qual­i­fied for seven years, fined €750, and re­ceived a sen­tence of three months in prison.

Boudakhan was ac­cused of hav­ing no in­surance or driv­ing li­cence at Kil­coole Road, Grey­stones, on May 25, 2016.

An off-duty garda was trav­el­ling in the area that day and saw Boudakhan driv­ing a sil­ver Opel As­tra, the court heard.

On June 1, 2016, the garda spoke to Boudakhan and asked for his li­cence and in­surance. He said he would pro­duce them in Car­low.

He then told the garda that his brother had been driv­ing.

‘It was 100 per cent not his brother,’ the garda said. Boudakhan did not pro­duce the doc­u­ments.

Bar­ris­ter Shan­non Biondi said that the garda could not be as cer­tain as he is say­ing. ‘ There has to be doubt in the court’s mind,’ she said.

Boudakhan told the court that he was not driv­ing that day, that it was his brother. He said that he does not look that much like his brother, but they have the same colour­ing.

Boudakhan in­tends to ap­peal the con­vic­tion.
