Uninsured man said brother was driving
A MAN who claimed his brother was driving was convicted last week of having no insurance.
Farid Boudakhan (37), with addresses in Carlow and Enniskerry, appeared in Bray District Court last Thursday, where he was disqualified for seven years, fined €750, and received a sentence of three months in prison.
Boudakhan was accused of having no insurance or driving licence at Kilcoole Road, Greystones, on May 25, 2016.
An off-duty garda was travelling in the area that day and saw Boudakhan driving a silver Opel Astra, the court heard.
On June 1, 2016, the garda spoke to Boudakhan and asked for his licence and insurance. He said he would produce them in Carlow.
He then told the garda that his brother had been driving.
‘It was 100 per cent not his brother,’ the garda said. Boudakhan did not produce the documents.
Barrister Shannon Biondi said that the garda could not be as certain as he is saying. ‘ There has to be doubt in the court’s mind,’ she said.
Boudakhan told the court that he was not driving that day, that it was his brother. He said that he does not look that much like his brother, but they have the same colouring.
Boudakhan intends to appeal the conviction.
