Mo­torist caught with­out in­sur­ance for fourth time

A MO­TORIST caught for the fourth time driv­ing with­out in­sur­ance may avoid a cus­to­dial sen­tence if a Pro­ba­tion Re­port on him is pos­i­tive.

James Spell­man (42) was warned by Judge Der­mot Dempsey the re­port ‘ bet­ter be good - or you are go­ing to jail.’

He also warned Spell­man he is on his last op­por­tu­nity. Swords District Court heard the de­fen­dant was stopped driv­ing at Prom­e­nade Road near Dublin Port on April 4th.

The de­fen­dant, of Deer­park Lodge in Tal­laght, ad­mit­ted he had no in­sur­ance and failed to pro­duce in­sur­ance within ten days. He has three pre­vi­ous for no in­sur­ance, the court heard. De­fence so­lic­i­tor Fiona D’arcy said the de­fen­dant, who was home­less at the time, was sleep­ing in his car.

‘He has a his­tory of drug ad­dic­tion but he is clean now and get­ting his life back on track,’ said Ms D’arcy.

‘He has also se­cured hous­ing and is ask­ing for le­niency. He fell on hard times,’ she said.

Ad­journ­ing the case un­til De­cem­ber, Judge Dempsey or­dered a Pro­ba­tion Re­port and or­dered the de­fen­dant com­plete a Driv­ing Aware­ness Course.

‘It bet­ter be a good re­port or you are go­ing to jail. You are on your last op­por­tu­nity,’ warned Judge Dempsey.
