Motorist caught without insurance for fourth time
A MOTORIST caught for the fourth time driving without insurance may avoid a custodial sentence if a Probation Report on him is positive.
James Spellman (42) was warned by Judge Dermot Dempsey the report ‘ better be good - or you are going to jail.’
He also warned Spellman he is on his last opportunity. Swords District Court heard the defendant was stopped driving at Promenade Road near Dublin Port on April 4th.
The defendant, of Deerpark Lodge in Tallaght, admitted he had no insurance and failed to produce insurance within ten days. He has three previous for no insurance, the court heard. Defence solicitor Fiona D’arcy said the defendant, who was homeless at the time, was sleeping in his car.
‘He has a history of drug addiction but he is clean now and getting his life back on track,’ said Ms D’arcy.
‘He has also secured housing and is asking for leniency. He fell on hard times,’ she said.
Adjourning the case until December, Judge Dempsey ordered a Probation Report and ordered the defendant complete a Driving Awareness Course.
‘It better be a good report or you are going to jail. You are on your last opportunity,’ warned Judge Dempsey.
