A MAN who swapped seats with his girlfriend after gardaí stopped his car following a series of dangerous driving manoeuvres has escaped a jail sentence.

Eugene Flanagan was spotted driving erratically and tailgating an off-duty garda on the main Derry to Letterkenny Road while flashing his vehicle’s lights at around 9.30pm on April 18.

He overtook the garda on a continuous white line and then pulled into a hard shoulder.

After the garda passed him, Flanagan again repeated the manoeuvre. Gardaí were alerted and stopped Flanagan at Burt, Co. Donegal. Gardaí found that Flanagan, 39, of 19 Crawford Square, Derry, had swapped seats with his female passenger, who was his girlfriend.

He appeared at Letterkenny District Court yesterday charged with dangerous driving.

His lawyer said that his client did not make any excuses for his driving but claimed that his passenger had a medical emergency.

Judge Paul Kelly said it was no excuse and described the driving as ‘highly dangerous’. Judge Kelly reduced the charge to careless driving and fined Flanagan €200.
