Se­nior garda signed off let­ter

The Dis­clo­sures Tri­bunal heard yes­ter­day that a let­ter which cast a se­nior garda as mis­tak­enly mak­ing a se­ri­ous al­le­ga­tion against Sgt Mau­rice Mc­Cabe was signed off by the garda him­self. On Mon­day, the tri­bunal was told that a let­ter in which Supt Noel Cun­ning­ham is al­leged to have re­ported that Sgt Mc­Cabe ex­pressed a grudge against another of­fi­cer as the mo­tive for bring­ing his com­plaints of mal­prac­tice con­tained a grave mis­take. Tri­bunal lawyer Kath­leen Leader said a per­son other than Supt Cun­ning­ham had made the er­ror, wrongly sug­gest­ing that he was ac­cus­ing Sgt Mc­Cabe of ex­press­ing the grudge. Yes­ter­day, how­ever, Michael McDow­ell, coun­sel for Sgt Mc­Cabe, told the tri­bunal it was now known that Supt Cun­ning­ham ac­tu­ally signed off on the let­ter.

“Ms Leader said an er­ror was made in as­crib­ing to Noel Cun­ning­ham the view that he [Mc­Cabe] made al­le­ga­tions against Michael Clancy,” Mr McDow­ell told the tri­bunal. “And the tri­bunal will know that Noel Cun­ning­ham was shown the let­ter and signed a copy of it and was asked for his agree­ment of the con­tents.”

How ex­actly the let­ter, which Sgt Mc­Cabe be­lieves was de­signed to at­tack him, came to be cre­ated will be ex­plored by the in­quiry in the com­ing weeks.
