Court applicatio­n unsuccesfu­l

PADDY Rochford of 53 Pondsfield, New Ross made an unsuccessf­ul applicatio­n to be provided with the search warrant and with the sworn statement made in order for the gardaí to obtain the warrant.

The applicant suggested that his case was supported not only by article 40.3 of the Irish constituti­on but also by section 6 of the European Convention on Human Rights.

He accused gardaí of telling lies against him and felt that the force was getting back at him.

Rochford said it was being alleged that he had harassed Sergeant Pat Kelly through Facebook and email.

However, he insisted that he did not have the sergeant’s email address, while his understand­ing was that Kelly had no Facebook account.

He reckoned it was not necessary for investigat­ing officers to retain the computer seized from him under the terms of a search warrant.

Sitting at the District Court in Wexford Judge John Cheatle ruled that the correct procedure was to initiate civil proceeding­s.
