Two cases, each alleging the sale of intoxicating liquor to persons U-18, have been struck out, after the prosecution admitted the original summonses can’t be found.
Colin Fee (61), Maxol filling station, Castletown Road, Dundalk, and Eugene Fee (59), Mace supermarket, Greenacres Shopping Centre, Dundalk, were each accused of the offence at their respective premises on 19 August, 2016.
Previously, defence solicitor James MacGuill argued on the delay in bringing the matters before court, and the cases were adjourned to allow gardaí respond.
In court last week, Sgt. Fintan McGroder said the original summonses can’t be located.
Judge Coughlan struck out the charges.
