KPA ap­peals High Court or­ders to file cranes sup­ply ten­der pa­pers

The Kenya Ports Author­ity (KPA) has ap­pealed against High Court or­ders di­rect­ing it to file doc­u­ments re­lat­ing to an in­ter­na­tional ten­der for the sup­ply of three cranes.

The ports agency, through Ka­plan and Strat­ton ad­vo­cates filed no­tice of ap­peal stat­ing that it was dis­sat­is­fied with or­ders is­sued by Jus­tice Said Chitem­bwe di­rect­ing its man­ag­ing director Cather­ine Mturi to file the re­port about the pro­cure­ment process.

“Take no­tice that KPA in­tends to ap­peal against the whole of the de­ci­sion,” states the no­tice of ap­peal.

The court made the or­ders in a case where MS Kocks Krane GMBH of Ger­many has sought the can­cel­la­tion the ten­der. The con­tract was awarded to Lieb­herr Con­tainer Cranes of Ire­land. The Ger­man firm main­tains the con­tract, which it lost, was not awarded com­pet­i­tively.

The KPA has since served lawyers rep­re­sent­ing var­i­ous re­spon­dents with the ap­peal no­tice to brace them­selves for fur­ther le­gal tus­sle in the lu­cra­tive dis­pute.
