KPA appeals High Court orders to file cranes supply tender papers
The Kenya Ports Authority (KPA) has appealed against High Court orders directing it to file documents relating to an international tender for the supply of three cranes.
The ports agency, through Kaplan and Stratton advocates filed notice of appeal stating that it was dissatisfied with orders issued by Justice Said Chitembwe directing its managing director Catherine Mturi to file the report about the procurement process.
“Take notice that KPA intends to appeal against the whole of the decision,” states the notice of appeal.
The court made the orders in a case where MS Kocks Krane GMBH of Germany has sought the cancellation the tender. The contract was awarded to Liebherr Container Cranes of Ireland. The German firm maintains the contract, which it lost, was not awarded competitively.
The KPA has since served lawyers representing various respondents with the appeal notice to brace themselves for further legal tussle in the lucrative dispute.
