Makau Mu­tua was among seven peo­ple who had been locked out of the interview by the JSC. But High Court judge Ge­orge Odunga di­rected the JSC to re­con­sider their ap­pli­ca­tions. He said the JSC’s de­ci­sion to sum­mar­ily re­ject ap­pli­ca­tions was not sup­ported by the law and was “tainted with pro­ce­dural ir­reg­u­lar­ity”. The ex­panded short­list also brought in for­mer Court of Ap­peal judge Aaron Ringera, Supreme Court judge Jack­ton Ojwang, David Wai­higa, Daniel Wam­bura and Lucy Wanja. Paul Udoto Kon­gani opted out of the race when he ap­peared be­fore the panel, since he did not meet the min­i­mum qual­i­fi­ca­tions for the job. Wai­higa said he pre­ferred the DCJ’s job and that of the Supreme Court judge. Jus­tice Ojwang will be the last to be in­ter­viewed to­day then the JSC will take a two-week break, be­fore em­bark­ing on in­ter­views for the DCJ.
