Makau Mutua was among seven people who had been locked out of the interview by the JSC. But High Court judge George Odunga directed the JSC to reconsider their applications. He said the JSC’s decision to summarily reject applications was not supported by the law and was “tainted with procedural irregularity”. The expanded shortlist also brought in former Court of Appeal judge Aaron Ringera, Supreme Court judge Jackton Ojwang, David Waihiga, Daniel Wambura and Lucy Wanja. Paul Udoto Kongani opted out of the race when he appeared before the panel, since he did not meet the minimum qualifications for the job. Waihiga said he preferred the DCJ’s job and that of the Supreme Court judge. Justice Ojwang will be the last to be interviewed today then the JSC will take a two-week break, before embarking on interviews for the DCJ.
