Woman sues plas­tic sur­geon for us­ing her im­age

A woman has sued a doc­tor deal­ing with plas­tic and re­con­struc­tive surgery for us­ing her im­age to ad­ver­tise his busi­ness with­out her con­sent.

Jes­sica Wan­jiru says Davinci Aes­thet­ics and Re­con­struc­tion Cen­tre and owner Nang’ole Wan­jala are us­ing her im­ages on its of­fi­cial web­site to mar­ket and ad­ver­tise the fa­cil­ity’s busi­ness.

Through lawyer Bemih Kany­onge, Wan­jiru says she has suf­fered both emo­tion­ally and psy­cho­log­i­cally due to the con­tin­ued use of her im­ages to pro­mote a ser­vice and pro­ce­dure she has never un­der­gone and does not in­tend to.

“Doc­tor Wan­jala and his fa­cil­ity have re­fused to pull down the bill boards bear­ing the im­ages or re­move the im­ages from their web­site. The court should de­clare that the re­spon­dents vi­o­lated my right to pri­vacy and dig­nity,” she says.

Wan­jiru wants the court to de­clare the the bill­board along the road lead­ing to the Keny­atta Hospi­tal in Nairobi un­law­ful.
