Lawyer and client charged with fraud in land trans­fer

A man and a lawyer have been charged with forg­ing a sig­na­ture to trans­fer own­er­ship of land.

The charges state that on June 24, 2011, Earnest Mwaniki was ar­rested and taken to the Kasarani po­lice sta­tion, Nairobi, for forg­ing Paul Ng’ang’a’s sig­na­ture.

The court heard that Ng’ang’a had agreed to sell his Sh7 mil­lion land to Mwaniki and they both signed an agree­ment in the pres­ence of lawyer Joseph Nzioki, the sec­ond ac­cused. Mwaniki paid a de­posit of Sh300,000. Af­ter two days, Ng’ang’a went to the lawyer’s of­fice, but he wasn’t given the bal­ance of the land price.

He then vis­ited the lands of­fice to do a search and the sys­tem in­di­cated that Mwaniki was the owner of the land.

The trans­fer had been done with­out his con­sent, Ng’ang’a said.

He re­ported the mat­ter to the po­lice.
