(+) HIGH COURT OVER­TURNED COUN­CIL’S DE­CI­SION

In April, the High Court ruled that the Coun­cil of Le­gal Ed­u­ca­tion has no ju­ris­dic­tion to ac­credit or with­draw cour­ses of­fered at Kenyan uni­ver­si­ties. The rul­ing by judge Ge­orge Odunga quashed the Coun­cil’s Septem­ber 2015 de­ci­sion that re­strained Moi Univer­sity and oth­ers from of­fer­ing a law de­gree course. Jus­tice Odunga said the CLE has no ju­ris­dic­tion on its mo­tion to sus­pend law cour­ses of­fered in uni­ver­si­ties. The court also di­rected the coun­cil be re­con­sti­tuted within 60 days, fail­ing which it would be deemed to be il­le­gally in of­fice.
