Court stops arrest of fraud suspect in Kitui MP case
The High Court has stopped police from arresting and prosecuting a businessman accused of obtaining Sh10 million from Kitui South MP Rachael Kaki Nyamai by pretence.
Milimani chief magistrate Daniel Ogembo was told James Kimanthi Mbaluka had obtained orders from the High Court barring his prosecution. His lawyer asked the court to defer the plea to December 16. Mbaluka, who is out on Sh50,000 police bond, moved to the High Court yesterday, stopping the DPP from prosecuting him over the alleged criminal offence.
