Schools as­so­ci­a­tion ac­cuses county of im­pos­ing il­le­gal taxes on its mem­bers

An as­so­ci­a­tion has sued the Nairobi govern­ment over il­le­gal taxes levied on its mem­bers. The Com­ple­men­tary Schools’ As­so­ci­a­tion of Kenya, which pro­vides al­ter­na­tive ba­sic ed­u­ca­tion, says the county is im­pos­ing tax on its mem­bers de­spite the fact that they are com­mu­nity-based or­gan­i­sa­tions. Its mem­bers in the Dagoretti sub-branch, which is in court, com­prise more than 200 schools pro­vid­ing ba­sic ed­u­ca­tion to chil­dren from in­for­mal set­tle­ments. The as­so­ci­a­tion says the county im­poses the taxes and de­mands it is­sue a sin­gle busi­ness per­mit. It said the county is act­ing in ex­cess of its au­thor­ity. The as­so­ci­a­tion said the schools are not busi­nesses so they should not pay taxes. It says the county de­ci­sion also goes against the Pub­lic Ben­e­fits Or­gan­i­sa­tions Act be­cause it hin­ders much-needed ser­vices to the pub­lic. It wants the High Court to is­sue an or­der stop­ping the taxes.
