EABL’s relief in supply dispute with Bia Tosha
PETER NG’ETICH/ East Africa Breweries has gotten a reprieve in the dispute with Bia Tosha, a beer distributor, after the Court of Appeal temporarily stopped a case in the High Court in which the distributor had sued it. Appellant judges Hellen Okwengu, GBM Kariuki and Fatuma Sichale have stopped Justice Louis Onguto from hearing the case. Bia Tosha had moved to the court seeking orders to bar EABL from appointing a new distributor in towns the distributor used to cover. They include Lang’ata, Rongai, Kiserian, Magadi Upper Hill, Ngong Road, Hurlingham, Kitengela, Athi River, Industrial Area, South B, Nairobi West, Kawangware, Satellite, Dagoretti, Namanga, Bissil and Kajiado among others. “We hereby stop the High Court proceedings until we hear and determine the application before us,” the judges ruled on Wednesday.
