EABL’s re­lief in sup­ply dis­pute with Bia Tosha

PETER NG’ETICH/ East Africa Brew­eries has got­ten a re­prieve in the dis­pute with Bia Tosha, a beer distrib­u­tor, af­ter the Court of Ap­peal tem­po­rar­ily stopped a case in the High Court in which the distrib­u­tor had sued it. Ap­pel­lant judges Hellen Ok­wengu, GBM Kar­iuki and Fa­tuma Sichale have stopped Jus­tice Louis Onguto from hear­ing the case. Bia Tosha had moved to the court seek­ing or­ders to bar EABL from ap­point­ing a new distrib­u­tor in towns the distrib­u­tor used to cover. They in­clude Lang’ata, Ron­gai, Kis­e­rian, Ma­gadi Up­per Hill, Ngong Road, Hurling­ham, Kiten­gela, Athi River, In­dus­trial Area, South B, Nairobi West, Kawang­ware, Satel­lite, Dagoretti, Na­manga, Bis­sil and Ka­ji­ado among oth­ers. “We hereby stop the High Court pro­ceed­ings un­til we hear and de­ter­mine the ap­pli­ca­tion be­fore us,” the judges ruled on Wed­nes­day.
