APEX COURT FALLS BE­LOW 5-JUDGE MIN­I­MUM

Mid this year, the Supreme Court fell be­low the five-judge bench con­sti­tu­tional min­i­mum to hear cases. That fol­lowed the re­tire­ment of Maraga’s pre­de­ces­sor Willy Mu­tunga. The court also was de­pleted by the forced re­tire­ment of former Deputy Chief Jus­tice Kal­pana Rawal and Supreme Court judge Philip Tunoi. Rawal and Tunoi had readed the 70 years re­tire­ment age. Chief Jus­tice David Maraga yes­ter­day said Kenyans should not ex­pect a dis­jointed Supreme Court.
