Court de­clines to en­force sum­mons against 2 sus­pects

A Mom­basa court has de­clined to en­force sum­mons is­sued against two em­ploy­ees of a scrap metal com­pany.

“It is the work of the of­fice of the DPP to en­sure court sum­mons are obeyed,” Mom­basa prin­ci­pal mag­is­trate Henry Nyak­weba said.

He ex­on­er­ated the ju­di­ciary for not en­forc­ing the sum­mons against Fran­cis Kar­itu and Agnes Wair­imu, who are charged to­gether with three oth­ers with ex­port­ing scrap bat­ter­ies by con­ceal­ing them as part of a tea con­sign­ment.

The two, who are em­ploy­ees of Bul­lion Metal Works, are al­leged to have con­spired to con­tra­vene the East African Com­mu­nity Cus­toms Man­age­ment Act.

Pros­e­cu­tor Nandi Rose­mary had asked the court to en­force the sum­mons, af­ter the two sus­pects failed to take a plea. The hear­ing is on De­cem­ber 15.
