Court declines to enforce summons against 2 suspects
A Mombasa court has declined to enforce summons issued against two employees of a scrap metal company.
“It is the work of the office of the DPP to ensure court summons are obeyed,” Mombasa principal magistrate Henry Nyakweba said.
He exonerated the judiciary for not enforcing the summons against Francis Karitu and Agnes Wairimu, who are charged together with three others with exporting scrap batteries by concealing them as part of a tea consignment.
The two, who are employees of Bullion Metal Works, are alleged to have conspired to contravene the East African Community Customs Management Act.
Prosecutor Nandi Rosemary had asked the court to enforce the summons, after the two suspects failed to take a plea. The hearing is on December 15.
