Im­peach­ment mo­tion filed against Gov­er­nor Mu­tua

Leader of Maen­deleo Chap Chap party calls the planned im­peach­ment a plot to pun­ish him for re­fus­ing to bow to MCAs who want him to fund their cam­paigns

Machakos Gov­er­nor Al­fred Mu­tua is fac­ing im­peach­ment for al­leged mis­use of funds and abuse of of­fice.

A no­tice of mo­tion for im­peach­ment was filed yes­ter­day in the assem­bly. It will be de­bated next Wed­nes­day.

The no­tice by Ndalani MCA Stephen Muthuka cites nu­mer­ous grounds for re­moval, in­clud­ing vi­o­la­tion of the Con­sti­tu­tion, pro­cure­ment law and County Gov­ern­ment Act.

Mu­tua says, how­ever, the planned im­peach­ment re­sults from his re­fusal to fund the cam­paigns of MCAs, as they have de­manded.

The mo­tion al­leges ir­reg­u­lar pay­ment of Sh89 mil­lion for the de­silt­ing of Maruba Dam and con­tract award for con­struc­tion of an ac­cess road.

Muthuka says no work was done from Jan­uary to Fe­bru­ary, as the coun­try ex­pe­ri­enced el Nino and de­silt­ing of the dam could not take place. He says Mu­tua and his ad­min­is­tra­tion went ahead to make an il­le­gal pay­ment on a false cer­tifi­cate that was not backed by ac­tual work on the ground.

Muthuka has pointed out what he calls ir­reg­u­lar trans­fer of Danida funds from county ac­counts to per­sonal ac­counts, through cash and hefty with­drawals and pay­ments.

“The gov­er­nor and his ad­min­is­tra- tion presided over il­le­gal and ir­reg­u­lar mis­ap­pro­pri­a­tion of grants and trans­fers from Danida and World Health Or­ga­ni­za­tion amount­ing to Sh161 mil­lion to Machakos county WHO PROSPECT ACT C/A – COUNTY GOV­ERN­MENT,” the mo­tion reads.

Muthuka has ac­cused Mu­tua of us­ing county funds to mount signs pro­mot­ing his Maen­deleo Cha Chap party. He calls it abuse of of­fice and mis­use of pub­lic funds for the gov­er­nor to launch and brand projects as if they were MCCac­tiv­i­ties and pro­grammes.

Other ac­cu­sa­tions in­clude ir­reg­u­lar pur­chase of ve­hi­cles, ir­reg­u­lar pay­ment of con­fi­den­tial ex­pen­di­ture amount­ing Sh7.5 mil­ion and fail­ure to es­tab­lish in­ter­nal au­dit mech­a­nisms.
