NCIC of­fi­cer called to ex­plain ev­i­dence against Kabogo

A se­nior NCIC in­ves­ti­ga­tor has been sum­moned to court to clar­ify ev­i­dence that links Ki­ambu Gover­nor Wil­liam Kabogo to dis­parag­ing ut­ter­ances against Cord leader Raila Odinga.

Dur­ing cel­e­bra­tions to mark mu­si­cian John de Mathew’s 30-year mu­sic ca­reer at Thika Sta­dium on Oc­to­ber 25 last year, Kabogo al­legedly said “fore­skins in­hibit think­ing”. The state­ment was taken to be di­rected at Raila .

Mil­i­mani se­nior prin­ci­pal mag­is­trate Martha Mu­tuku or­dered chief in­ves­ti­gat­ing of­fi­cer Robert Mabera to ap­pear be­fore her on De­cem­ber 14.

He is ex­pected to shed more light on the case af­ter a wit­ness was un­able to ver­ify the cor­re­spon­dence be­tween the NCIC and the pros­e­cu­tion.

The pros­e­cu­tion ap­plied to have the in­ves­ti­ga­tor sum­moned af­ter his col­league John Ka­mau was un­able to ex­plain the au­then­tic­ity of wit­ness state­ments and footage used as ev­i­dence against Kabogo.

The wit­ness, who was be­ing cros­sex­am­ined by Kabogo’s lawyers, told the court he was un­aware of the let­ters that rec­om­mended Kabogo’s pros­e­cu­tion.

Ka­mau said it is only the chief in­ves­ti­gat­ing of­fi­cer who can ex­plain why the NCIC and DPP de­cided to charge the gover­nor.
