‘Ma­li­cious ac­tion’ not al­lowed

Mnahi Obaid Al-Osaimi, a stu­dent at Kuwait Univer­sity’s Com­mer­cial Stud­ies Col­lege (Law Depart­ment), car­ried out a study on ju­di­cial rul­ing im­ple­men­ta­tion, which con­cluded that the im­ple­men­ta­tion of a court’s verdict is not to be done with­out rules and stan­dards. The Kuwaiti leg­is­la­tor al­lowed the im­ple­men­ta­tion of a court verdict, but did not al­low ma­li­cious ac­tion, which means when a rul­ing goes in a per­son’s fa­vor in a case in which he is in­debted with a small debt, the de­mand of re­pay­ment should not re­quire the sale of a house or any other per­sonal prop­erty to re­pay said debt.
