This overview is necessitated by an acute lack of reference materials and reliable authoritative sources coupled with alleged misguided views and practices of those in the insurance industry, notwithstanding the terms and conditions in the Endorsement No:
his overview must be read in conjunction with the Endorsement. For the sake of simplicity, the terms and conditions of coverage of the Endorsement are referred under the respective paragraphs. The executive summary of the Endorsement is as follows:
Paragraph 1: The preamble;
Paragraph 2: Proviso to the preamble; Paragraph 3: Complete (full) utilisation of sum insured with an option to reinstate; Paragraph 4: (a) Incomplete (partial) utilisation of the original sum insured and (b) Reinstatement of fully utilised original sum insured (reinstated sum insured) “during the currency of this period” (“remaining policy period”). Paragraph 5: Dispute on option to repair or replace; Paragraph 6: Subject to general terms and conditions of the policy.
Paragraph 1 of the Endorsement is the preamble, which provides the requisite ingredients of what constituted a contract of windscreen insurance. Briefly, there is an offer, an acceptance, a consideration and a promissory to compensate “up to an amount not exceeding the sum shown in the schedule” (hereinafter referred to as “the sum insured”).
