DATUK Seri Najib Razak says A-G Tommy Thomas’ previous article on 1MDB shows that he is prejudiced against him. Najib is seeking Thomas’ removal from the prosecution team.
FORMER prime minister Datuk Seri Najib Razak claims it is prejudicial if Attorney-General (A-G) Tommy Thomas is allowed to continue leading the prosecution team in the criminal breach of trust and power abuse case against him.
In his originating summons filed against Thomas, Najib said the A-G had written an article entitled “Grand Larceny in 1MDB (1Malaysia Development Bhd)” on July 26, 2016, which concluded that he had taken money from 1MDB into his personal account.
The article was published on news portal Malaysiakini.
“Thomas’ stand is clear that he does not like me, which was reflected in the article.
“And, this causes concern that he may find means to ensure and prefer a charge against me for any reason.
“The article clearly shows that Thomas has his own stand against me and I feel that I will not be given fair consideration.
“Thomas should not and is not qualified to be involved in the investigation into 1MDB by any means,” said Najib in his supporting affidavit.
The former Barisan Nasional chairman, through his counsel Badrul Abdullah, filed three suits against Thomas and two others, who are top investigators involved in the probe into 1MDB, on June 30.
The other respondents are Malaysian Anti-Corruption Commission Chief Commissioner Datuk Seri Mohd Shukri Abdull and Bukit Aman Commercial Crimes Investigation Department chief Datuk Seri Amar Singh.
In an ex-parte application filed against Shukri, Najib said the former, during a press conference held after he was appointed the new MACC chief, had prematurely concluded that he had taken RM42 million and RM2.6 billion from SRC International Sdn Bhd.
Najib said the press conference was held before he was summoned by MACC to have his statement recorded to assist investigations into SRC International.
He said the statement made by Shukri at the press conference was emotionally-charged and vengeful, apart from portraying him as guilty.
“By making such statements, the integrity and professionalism of Shukri can be disputed.
“He is supposed to take a neutral stand until investigations into the case have been completed, but he chose to punish me without a solid foundation.
“In this situation, I feel that I will not be accorded an investigation that is just and transparent.”
Najib, in his supporting affidavit for his originating summons against Amar, said Amar was responsible for leading police raids on premises occupied by his children at Pavilion Residences and one loaned by a friend to store items moved from his official residence in Seri Perdana.
Najib said the raid by Amar and his team did not comply with standard operating procedures (SOP). He said a report had been lodged against Amar.
“I have also instructed Tetuan Badrul, Samad, Faik & Co to file an official complaint on the non-compliance with SOP with the Integrity Commission,” he said.
Najib said Shukri was not qualified to lead the MACC investigation team as well as to be a member of the 1MDB task force.
He said Amar was not qualified to advise the investigation team formed to probe the case.
A police report, said Najib, had been lodged over the actions of Thomas, Shukri and Amar.
Lawyers representing Najib and the respondents were scheduled to meet two judges for separate pre-trial hearings on July 16.
