KUCHING: An unemployed man was sentenced to a total of 22 years in prison and two strokes of the cane for attempting to rape and committing indecent sexual act on an underage girl.

Jethro Reddie Samen, 26, was found guilty of committing the offence on the girl, 15, at one of the villages in Jalan Padawan near here around 9am on Oct 20 last year.

Judge Afidah Abdul Rahman ruled that his defence call had failed to raise reasonable doubt on the prosecution case.

For the first charge, Afidah sentenced Jethro to 10 years’ jail and two cane strokes for attempted rape, a charge read under Section 376( 2)(d) of the Penal Code, read together with Section 511 of the same Act.

He was sentenced to 12 years’ jail for inserting his finger into the girl’s private part, an offence listed under Section 377(a) of the same Act.

The judge ordered the custodial sentence to take effect from the date of his arrest (Oct 20 last year), and that the sentences are to run concurrently.

He therefore only needs to serve 12 years in prison.

DPP Ahmad Fariz Abdul Hamid prosecuted.
