‘Fair com­ment’ de­fence struck out

PUTRAJAYA: Prime Min­is­ter Datuk Seri Na­jib Ab­dul Razak and his wife Datin Seri Ros­mah Man­sor yes­ter­day suc­ceeded in their defama­tion suit ap­peals to strike out a de­fence of “fair com­ment” by PKR vi­cepres­i­dent Mohd Rafizi Ramli and Me­dia Rakyat on­line news portal owner, Chan Chee Kong.

Na­jib and Ros­mah sued Mohd Rafizi, over his state­ment al­legedly dis­parag­ing them at a fo­rum on oil sub­sidy in Ban­dar Tun Razak on Nov 22, 2014.

They al­leged that a record­ing of the speech was up­loaded by Chan or his as­sis­tant on the portal, YouTube and Face­book.

The plain­tiffs are seek­ing gen­eral, ag­gra­vated and ex­em­plary dam­ages as deemed fit by the court, in­ter­est and costs.

They sought to strike out the “fair com­ment” de­fence on grounds that the dis­puted words were “state­ment of facts and not state­ment of com­ments”.

Coun­sel for Mohd Rafizi and Chan, Ra­zlan Hadri Zulk­i­fli, said he would seek in­struc­tions from his clients on whether to bring the mat­ter up to the Fed­eral Court. – Ber­nama
