Habeas cor­pus writ struck out

KUALA LUMPUR: Ber­sih 2.0 steer­ing com­mit­tee chair­man Maria Chin Ab­dul­lah’s habeas cor­pus (un­law­ful de­ten­tion) ap­pli­ca­tion to chal­lenge her de­ten­tion un­der the Se­cu­rity Of­fences (Spe­cial Mea­sures) Act 2012 (Sosma) was struck out by the Kuala Lumpur High Court yes­ter­day.

High Court ju­di­cial com­mis­sioner Datuk Nordin Has­san said the le­gal ad­viser of the Home Min­istry had sent a let­ter in­form­ing of Maria Chin’s re­lease and that they were not fil­ing an af­fi­davit-in-re­ply to the habeas cor­pus ap­pli­ca­tion.

He said it is no longer nec­es­sary for the court to de­cide on the writ of habeas cor­pus.

“The court is in no po­si­tion to de­cide on the writ. No af­fi­davit-in-re­ply was filed, what more to de­cide on the dam­ages,” said Nordin.

“The ap­pli­ca­tion of writ of habeas cor­pus is struck out,” ruled Nordin.
