There might be a big ques­tion over whether Taupo District Coun­cil has dis­qual­i­fied it­self from ever build­ing on the Ton­gariro Do­main! In the con­sul­ta­tion doc­u­ment that sealed the fate of 72 Lake Ter­race the ques­tion asked was should 72 Lake Ter­race be sold in or­der to de­fray costs of build­ing else­where “on coun­cil owned land”. That was the op­tion that passed, so un­less the coun­cil can pro­vide proof that they ac­tu­ally have free­hold ti­tle to land some­where on the Do­main they must have dis­qual­i­fied them­selves from build­ing there. If they have no ti­tle to land on the Do­main, the only way they can build there is if they can in some way legally nul­lify that con­sul­ta­tion doc­u­ment? I be­lieve coun­cil’s func­tion on the Do­main is man­age­ment not own­er­ship.
