Draughts­men lose bid to vet build­ing plan in Ogun

Ogun State High Court has dis­missed the re­quest of the Nige­rian As­so­ci­a­tion of Draughts­men seek­ing to ap­prove and con­trol build­ing plans in the state.

Jus­tice Olan­re­waju Mabekoje held in his ver­dict that the ac­tion of the draughts­men is un­mer­i­to­ri­ous.

He awarded the sum of N17,500 as judg­ment cost in fa­vor of the gover­nor of Ogun State, Com­mis­sioner of Jus­tice, House of As­sem­bly, Com­mis­sioner of Phys­i­cal Plan­ning, Per­ma­nent Sec­re­tary, Min­istry of Phys­i­cal Plan­ning, Gen­eral Man­ager, Pan­ning Board, Ogun State and Ar­chi­tects Reg­is­tra­tion Coun­cil of Nigeria who were de­fen­dants in the suit in­sti­tuted by the claimant.

He held that the court lacks power to di­rect Ogun State House of As­sem­bly to in­clude the name of the claimant in the ap­pro­pri­ate places of the law and reg­u­la­tions com­plained of as a reg­is­tered as­so­ci­a­tion which can pre­pare, sub­mit, sign or counter-sign any build­ing plan.

The Nige­rian As­so­ci­a­tion of Draughtsman had ap­proached the court to seek a dec­la­ra­tion that it can pre­pare, sub­mit, sign and counter-sign any type of build­ing pan vis-à-vis the con­sent judg­ment de­liv­ered on the 16th day of March 1992 by Jus­tice C.O. Ja­cobs (re­tired) in suit num­ber AB/204/1990 be­tween Mr Ayo Olu Odu­dena and three oth­ers ver­sus Arc. Cle­ment Sanyaolu and two oth­ers which re­main valid, sub­sist­ing, bind­ing and un­ap­peal­ing till date.
