Draughtsmen lose bid to vet building plan in Ogun
Ogun State High Court has dismissed the request of the Nigerian Association of Draughtsmen seeking to approve and control building plans in the state.
Justice Olanrewaju Mabekoje held in his verdict that the action of the draughtsmen is unmeritorious.
He awarded the sum of N17,500 as judgment cost in favor of the governor of Ogun State, Commissioner of Justice, House of Assembly, Commissioner of Physical Planning, Permanent Secretary, Ministry of Physical Planning, General Manager, Panning Board, Ogun State and Architects Registration Council of Nigeria who were defendants in the suit instituted by the claimant.
He held that the court lacks power to direct Ogun State House of Assembly to include the name of the claimant in the appropriate places of the law and regulations complained of as a registered association which can prepare, submit, sign or counter-sign any building plan.
The Nigerian Association of Draughtsman had approached the court to seek a declaration that it can prepare, submit, sign and counter-sign any type of building pan vis-à-vis the consent judgment delivered on the 16th day of March 1992 by Justice C.O. Jacobs (retired) in suit number AB/204/1990 between Mr Ayo Olu Odudena and three others versus Arc. Clement Sanyaolu and two others which remain valid, subsisting, binding and unappealing till date.
