NEWS Ab­dul­salami’s cousin sues Army, de­mands N95m com­pen­sa­tion

AMinna High Court is set to de­ter­mine whether one Mo­hammed Abubakar Al­haji, cousin to for­mer mil­i­tary head of state, Gen­eral Ab­dul­salami Abubakar, de­serves N95 mil­lion as com­pen­sa­tion for los­ing one of his legs in a shoot­ing by an Army sergeant in Au­gust 19, 2014.

Ac­cord­ing to the state­ment of claim and wit­ness state­ment on oath pre­sented in the court, one Sergeant Yakubu Ab­dul with ser­vice no 79NA/19/5520, the 4th re­spon­dent in the mat­ter, at about 3pm on 19/8/2014, got in­tox­i­cated and in a con­fronta­tional man­ner shot the plain­tiff in the leg at a very close range.

The in­ci­dent, Daily Trust learnt led to the am­pu­ta­tion of the plain­tiff’s leg, who now moves around with the aid of an ar­ti­fi­cial leg.

Ab­dul was said to have been dis­missed by the mil­i­tary au­thor­ity but was not handed over to the po­lice for pros­e­cu­tion.

In the writ of sum­mons pre­sented be­fore the court, Mo­hammed through his coun­sel, Ihe­mat­u­lam Gavers of the Lord of Jus­tice Cham­ber, prayed for an or­der against the re­spon­dents, which in­clude the Nige­ria Army, the Chief of Army Staff, Com­man­dant, 313 Ar­tillery Brigade, Minna and Sergeant Ab­dul, jointly and sev­er­ally for the sum of N50 mil­lion be­ing ag­gra­vated and ex­em­plary dam­ages for the “cruel and tor­tu­ous act” of the staff sergeant that re­sulted in his per­ma­nent de­for­mity.

He also prayed for an or­der of the court against the re­spon­dents jointly and sev­er­ally for the sum of N40 mil­lion for gen­eral dam­ages, emo­tional trauma, painful de­for­mity and un­nat­u­ral dis­abil­ity caused by bullet fired from the ser­vice pis­tol of the soldier which shat­tered his left leg lead­ing to its am­pu­ta­tion.

Mo­hammed prayed the court to cause the re­spon­dents to re­im­burse him the sum of N5 mil­lion he spent on his treat­ment.

The High Court or­dered sub­sti­tuted ser­vice on the Chief of Army Staff and the Nige­ria Army at De­fense Head­quar­ters Abuja at the 313 Ar­tillery reg­i­ment in Minna over the mat­ter.

The court presided over by Jus­tice Idris Evuti while rul­ing on a mo­tion ex­parte moved by coun­sel to the plain­tiff, also granted leave to the ap­pli­cant to is­sue and serve the writ of sum­mons on the Nige­ria Army and Chief of Army Staff whose ad­dress is De­fence Head­quar­ters Abuja, out­side the ju­ris­dic­tion of the court.
