NEWS Abdulsalami’s cousin sues Army, demands N95m compensation
AMinna High Court is set to determine whether one Mohammed Abubakar Alhaji, cousin to former military head of state, General Abdulsalami Abubakar, deserves N95 million as compensation for losing one of his legs in a shooting by an Army sergeant in August 19, 2014.
According to the statement of claim and witness statement on oath presented in the court, one Sergeant Yakubu Abdul with service no 79NA/19/5520, the 4th respondent in the matter, at about 3pm on 19/8/2014, got intoxicated and in a confrontational manner shot the plaintiff in the leg at a very close range.
The incident, Daily Trust learnt led to the amputation of the plaintiff’s leg, who now moves around with the aid of an artificial leg.
Abdul was said to have been dismissed by the military authority but was not handed over to the police for prosecution.
In the writ of summons presented before the court, Mohammed through his counsel, Ihematulam Gavers of the Lord of Justice Chamber, prayed for an order against the respondents, which include the Nigeria Army, the Chief of Army Staff, Commandant, 313 Artillery Brigade, Minna and Sergeant Abdul, jointly and severally for the sum of N50 million being aggravated and exemplary damages for the “cruel and tortuous act” of the staff sergeant that resulted in his permanent deformity.
He also prayed for an order of the court against the respondents jointly and severally for the sum of N40 million for general damages, emotional trauma, painful deformity and unnatural disability caused by bullet fired from the service pistol of the soldier which shattered his left leg leading to its amputation.
Mohammed prayed the court to cause the respondents to reimburse him the sum of N5 million he spent on his treatment.
The High Court ordered substituted service on the Chief of Army Staff and the Nigeria Army at Defense Headquarters Abuja at the 313 Artillery regiment in Minna over the matter.
The court presided over by Justice Idris Evuti while ruling on a motion exparte moved by counsel to the plaintiff, also granted leave to the applicant to issue and serve the writ of summons on the Nigeria Army and Chief of Army Staff whose address is Defence Headquarters Abuja, outside the jurisdiction of the court.
