S/Court con­firms sen­tence on sol­dier over de­file­ment

The Supreme Court has con­firmed the four year-jail term passed by a gen­eral court mar­tial on Cor­po­ral Isah Ahmed who was found guilty on a one count charge of de­file­ment.

Jus­tice Kudi­rat Kekere Ekun who read the lead­ing judg­ment on Fri­day, said the Court of Appeal was right when it af­firmed the de­ci­sion of the gen­eral court mar­tial that the prose­cu­tion had proved its case against the Cor­po­ral be­yond rea­son­able doubt.

Cor­po­ral Isah of the Nige­rian Army who works as a com­puter op­er­a­tor and teacher at the NAOWA Model Nursery and Pri­mary School and the family of the vic­tim all re­side in the same block at Mo­gadisu Can­ton­ment, Abuja.

Helen Waziri, the girl’s mother, had told the court that she had seen her daugh­ter out­side her school around 12pm when she ought to have been in her class­room. The girl was ques­tioned and even­tu­ally ad­mit­ted that Isah had slept with her. The court mar­tial found out that he had slept with the 11 year old girl sev­eral times be­tween Jan­uary 2004 and March 2005.

The court mar­tial then sen­tenced him to four years in prison. Dis­sat­is­fied, he went to the Court of Appeal which af­firmed the de­ci­sion but he fur­ther went to the apex court which con­firmed the de­ci­sion of the Appeal Court on Fri­day.
