2 brothers bag 30 years for raping minor
Two brothers, Chukwuedo Mogaha (30) and Amaechi Mogaha (33) have been sentenced to a total of 30 years in jail for gang-raping a 12-year-old girl.
Delivering the verdict in Akwukwu-Igbo High Court, Justice Marcel Okoh held that the court was able to establish conspiracy and rape against Chukwuedo, who was sentenced to seven years for conspiracy to commit rape and 14 years with hard labour for rape.
For Amaechi, Justice Okoh held that prosecution only proved conspiracy but failed to prove rape. He sentenced him to seven years for conspiracy and two years with hard labour for indecent assault of a girl under-13 years. The sentences are to run concurrently.
The State Counsel A. P. Popo had told the court that the two brothers committed the offence on or about the 6th day of June, 2015 at Ibusa, within the Akwukwu-Igbo Judicial Division, inside a classroom at primary school.
In her proof of evidence in court, the girl said, “My mother sent me to buy okro and I went to a small market but I did not see okro to buy. Somebody directed me to one Aunty Nkem’s house but I could not locate the house. It was at that point I saw the two men in a compound eating and I asked them if they knew the said Aunty Nkem’s house and they offered to lead me there. But on our way, one of them brought out a knife and dragged me inside the primary school and raped me in turns.”
