2 brothers bag 30 years for rap­ing mi­nor

Two brothers, Chuk­wuedo Mo­gaha (30) and Amaechi Mo­gaha (33) have been sen­tenced to a to­tal of 30 years in jail for gang-rap­ing a 12-year-old girl.

De­liv­er­ing the ver­dict in Ak­wukwu-Igbo High Court, Jus­tice Mar­cel Okoh held that the court was able to es­tab­lish con­spir­acy and rape against Chuk­wuedo, who was sen­tenced to seven years for con­spir­acy to com­mit rape and 14 years with hard labour for rape.

For Amaechi, Jus­tice Okoh held that prose­cu­tion only proved con­spir­acy but failed to prove rape. He sen­tenced him to seven years for con­spir­acy and two years with hard labour for in­de­cent as­sault of a girl un­der-13 years. The sen­tences are to run con­cur­rently.

The State Coun­sel A. P. Popo had told the court that the two brothers com­mit­ted the of­fence on or about the 6th day of June, 2015 at Ibusa, within the Ak­wukwu-Igbo Ju­di­cial Di­vi­sion, in­side a class­room at pri­mary school.

In her proof of ev­i­dence in court, the girl said, “My mother sent me to buy okro and I went to a small mar­ket but I did not see okro to buy. Some­body di­rected me to one Aunty Nkem’s house but I could not lo­cate the house. It was at that point I saw the two men in a com­pound eat­ing and I asked them if they knew the said Aunty Nkem’s house and they of­fered to lead me there. But on our way, one of them brought out a knife and dragged me in­side the pri­mary school and raped me in turns.”
