Bail: Omisore to know fate to­day

The rul­ing on a fun­da­men­tal rights ap­pli­ca­tion by a for­mer deputy gov­er­nor of Osun State, Iyi­ola Omisore, comes up to­day at an FCT High Court in Abuja.

Jus­tice Olukay­ode Adeniyi fixed the date after lis­ten­ing to ar­gu­ments of the counsel. Omisore is in the cus­tody of the Eco­nomic and Fi­nan­cial Crimes Com­mis­sion (EFCC) on al­le­ga­tions of fraud.

In the ap­pli­ca­tion by his counsel, Chris Uche (SAN), Omisore said his con­tin­ued de­ten­tion with­out a for­mal charge in a com­pe­tent court was a vi­o­la­tion of Sec­tion 35 of the 1999 Con­sti­tu­tion. Uche in­formed the court that Omisore was ar­rested on July 3 while the war­rant to ar­rest and de­tain him was ob­tained on July 8.

But EFCC counsel, Takon Nd­i­fon, op­posed the bail re­quest on the ground that the war­rant of ar­rest and the de­ten­tion or­der ob­tained from court per­mit­ted his de­ten­tion for 14 days to en­able the EFCC com­plete in­ves­ti­ga­tion into the al­le­ga­tions against him.
