Il­le­gal de­ten­tion: Court or­ders DSS to pro­duce de­tainee

A Fed­eral High Court in Abuja has or­dered the Depart­ment of State Ser­vices (DSS) to pro­duce Peter Erom­sele Unu­akhalu, who was ar­rested with­out any known of­fence.

Jus­tice Nnamdi Dimgba gave the or­der yes­ter­day fol­low­ing a fun­da­men­tal rights ap­pli­ca­tion brought by Unu­akhalu’s coun­sel, Charles Og­boli.

The coun­sel had pleaded with the court to grant bail to the ap­pli­cant be­cause the DSS has re­fused to re­lease him or grant his fam­ily ac­cess to him on health grounds.

In the af­fi­davit at­tached to the ap­pli­ca­tion by one Pre­cious Osariemen, the ap­pli­cant was on May 30 “Ap­pre­hended in the streets of La­gos with­out war­rant of ar­rest by agents of the re­spon­dents in a Gestapo like man­ner.”

The case has been ad­journed to Au­gust 21 for hear­ing.
