Again, FG ar­raigns three fake pa­tent medicine deal­ers in Kaduna

THE Fed­eral Gov­ern­ment of Nige­ria has dragged three male sus­pects; Afam Ofor, 26 years, Peter Gabriel, 30 years and Ed­win Nwo­bodo, 25 years, be­fore a Fed­eral High Court sit­ting in Kaduna for sell­ing and de­liv­er­ing pa­tent or pro­pri­etary medicines to un­sus­pect­ing gen­eral pub­lic with­out ap­proval. The sus­pects were brought be­fore Hon. Jus­tice Sale Musa on Thurs­day with four count charges..

The charges stated that the ac­cused per­sons not be­ing a sell­ing dis­penser, a chemist or a holder of a pa­tent and pro­pri­etary medicine ven­dors lin­cense did sell or de­liver pa­tent or pro­pri­etary medicines con­trary to sec­tion 34(1)(a) and (b) and pun­ish­able un­der sec­tion 34(2) of the poi­sons and phar­macy ACT, CAP 535, LFN 1990.

“Your shops were sealed af­ter found sell­ing or de­liv­er­ing medicines with­out pa­tent medicine ven­dor lin­cense and you were or­dered to com­ply by ob­tain­ing lin­cense but, you dis­obeyed the or­der and broke the seal and re­sumed sale of medicines un­law­fully thereby com­mit­ted an of­fence con­trary to and pun­ish­able un­der sec­tion 203 of the crim­i­nal code ACT L.F.N 2004”, the charges stated.

Other charges is that Afam Ofor and the two oth­ers will­fully and un­law­fully dam­aged prop­erty of Fed­eral Gov­ern­ment of Nige­ria worth N30, 000 for the seal and for dam­ag­ing pad­lock worth N2500 placed on their shops to close it for op­er­at­ing the shop with­out li­cense in breach of the law.

Although, the ac­cused per­sons who were cur­rently on ad­min­is­tra­tive bail pleaded not guilty to any of the count charges af­ter the charges were read to them by the court clark on the in­struc­tion of the pre­sid­ing Judge.

Af­ter sev­eral min­utes of ar­gu­ments from the coun­sel to the Fed­eral Gov­ern­ment, Barr. Shafiu Abubakar Mashanu on ei­ther there is the need for bail ap­pli­ca­tion as re­quested by the coun­sel to the de­fen­dants, Barr. Muhammed Ab­dul­lahi, the Court ad­journed the hear­ing for bail Ap­pli­ca­tion till 5th of De­cem­ber, 2017 on the agree­ment of the both Coun­sels.
