CAN OR WILL JU­DI­CIARY TACKLE BIG­GEST NA­TIONAL CRI­SIS ON ELEC­TORAL RE­FORMS?

With Con­sti­tu­tion’s Sadiq And Ameen Con­di­tion Gone For Can­di­dates To Qual­ify And Con­test, Worst Elec­tions Maybe Ahead! Can Liars And Dis­hon­est Also Take Part, Cheat And Win Polls!?

SEEMS worst elec­tions 2018 are ahead with com­mon peo­ple un­aware of laws be­ing led to ask a big and tough ques­tion: Can ju­di­ciary take suo moto ac­tion against leg­is­la­tion and pass­ing of bills that elim­i­nate elec­toral re­forms un­der a false guise of “do­ing elec­toral re­forms”!? If a bill is passed against na­tional in­ter­est, does Chief Jus­tice of Supreme Court of Pak­istan en­joy power and author­ity to stop it? Or is CJSC em­pow­ered only to fol­low any bad laws passed by Na­tional As­sem­bly, Sen­ate and Pres­i­dent? Many peo­ple may make many jokes around it which are un­men­tion­able here.

AFORE-GO­ING fears against na­tional in­ter­ests of a 200 mil­lion na­tion brings us to a seem­ingly im­pos­si­ble sit­u­a­tion to re­solve. How­ever, that might not be the case. It’s not a com­plex but a sim­ple con­di­tion that may be tack­led rel­a­tively eas­ier than imag­ined. Like Supreme Court’s ver­dict turned into a clash against peo­ple’s man­date! Or dis­posal of a con­sti­tu­tional prin­ci­ple of can­di­dates to be truth­ful (sadiq) and trust­wor­thy (ameen). Peo­ple fear that now su­per rich liars and su­per fraud­u­lent traitors can also take part, rig and cheat, and win polls: A pop­u­lar “fake” na­tional man­date. Now an ex-PM, ousted on be­ing not truth­ful and not trust­wor­thy, and his rul­ing party’s ma­jor­ity vote, can defy and change Con­sti­tu­tion, be­come party head and prime min­is­ter again, against Ju­di­ciary and Supreme Court’s ver­dict, and present re­sults of a fake and rigged elec­tions as na­tional man­date against Ju­di­ciary and Con­sti­tu­tion of Pak­istan!

SO­LU­TIONS are ob­vi­ous, lead­ing anal­y­sis on those con­cerned is­sues may have us be­lieve, to re­solve mat­ters with­out con­fronta­tion between in­sti­tu­tions: The law of the land must pre­vail, with­out na­tional in­ter­ests jeop­ar­dized. For ex­am­ple, ju­di­ciary can take suo moto no­tice and ac­tion on any le­gal point on which it is legally em­pow­ered, au­tho­rized and have ju­ris­dic­tion upon, and then fol­low it up from there to raise all in­ter-re­lated is­sues which are by the way end­less and re­solve out­stand­ing mat­ters to pro­tect na­tional in­ter­ests be­fore an­ar­chic politi­cians drive this coun­try to­wards an­other coup d’etat.

JU­DI­CIARY can sum­mon any leader and of­fi­cial, ex­er­cise its con­sti­tu­tional power and author­ity and as­cer­tain with a strong hand that its verdicts are im­ple­mented, com­plete in let­ter and spirit.
