Pun­jab no­ti­fies LB reps res­ig­na­tion rules

LA­HORE—Even the dis­tricts gov­ern­ments are not yet to be formed in Pun­jab, the gov­ern­ment has pro­posed rules re­gard­ing res­ig­na­tion of lo­cal bod­ies’ rep­re­sen­ta­tives from their posts. These rules may call ‘The Pun­jab Lo­cal Gov­ern­ments (Res­ig­na­tion) Rules, 2016’, were made un­der sec­tions 144(1) of the Pun­jab Lo­cal Gov­ern­ment Act, 2013 (XVIII of 2013).

A copy of these rules avail­able with Pak­istan Observer reads as, ‘these rules shall ap­ply to all lo­cal gov­ern­ments ex­cept Dis­trict Ed­u­ca­tion Au­thor­i­ties and Dis­trict Health Au­thor­i­ties es­tab­lished un­der the Pun­jab lo­cal Gov­ern­ment Act, 2013. A Mayor, Deputy Mayor, Chair­man, Vice Chair­man or a mem­ber of a lo­cal gov­ern­ment may re­sign from his of­fice by ten­der­ing res­ig­na­tion in writ­ing un­der his/her hand to the lo­cal gov­ern­ment of which he is rep­re­sen­ta­tive.

These elected per­sons shall de­liver his res­ig­na­tion in per­son to the Chief Of­fi­cer of the lo­cal gov­ern­ment con­cerned or the sec­re­tary union coun­cil. Rules fur­ther says, chief of­fi­cer of the lo­cal gov­ern­ment con­cerned or the Sec­re­tary Union Coun­cil, is not avail­able in his of­fice, the res- ig­na­tion shall be de­liv­ered to the per­son next in­charge of the of­fice of the lo­cal gov­ern­ment con­cerned. The chief of­fi­cer of the lo­cal gov­ern­ment con­cerned or the sec­re­tary union coun­cil shall within seven days of re­ceipt of res­ig­na­tion for­ward the copies of res­ig­na­tion to the Elec­tion Com­mis­sion of Pak­istan and the Gov­ern­ment with the ap­proval of the House of lo­cal gov­ern­ment con­cerned.

The of­fi­cer/of­fi­cial re­ceiv­ing the res­ig­na­tion un­der sub-rule (2) or (3), shall make an en-dorse­ment on the res­ig­na­tion cer­ti­fy­ing the fact of the res­ig­na­tion hav­ing been de­liv­ered to him in per­son, at free will, date and time of such de­liv­ery, and Shall en­ter the re­ceipt of the res­ig­na­tion in a reg­is­ter main­tained for the pur­pose.

If meet­ing of the House of a Lo­cal Gov­ern­ment is not pos­si­ble due to any rea­son, the Chief Of­fi­cer of Lo­cal Gov­ern­ment con­cerned or the Sec­re­tary Union Coun­cil af­ter as­cer­tain­ing free will of the Deputy Mayor or Vice Chair­man or mem­ber ten­der­ing the res­ig­na­tion, shall place it be­fore the Head of lo­cal gov­ern­ment con­cerned for ap­proval to for­ward the copies of res­ig­na­tion to the Elec­tion Com­mis­sion of Pak­istan and the Gov­ern­ment.
