SC re­serves ver­dict against mily courts death sen­tences

IS­LAM­ABAD—The Supreme Court of Pak­istan on Monday has re­served its judg­ment on five ap­peals against Pe­shawar High Court rul­ing given in cases re­gard­ing death sen­tences an­nounced by Mil­i­tary Courts.

A five mem­ber SC bench com­pris­ing Chief Jus­tice An­war Za­heer Ja­mali, Jus­tice Ameer Hani Mus­lim, Jus­tice Sheikh Az­mat Saeed, Jus­tice Man­zoor Ahmed Ma­lik and Jus­tice Faisal Arab heard 17 ap­peals against death sen­tences an­nounced by Mil­i­tary Courts.

Top Court re­served judg­ment over ap­peals of Haider Ali, Qari Zahir Gul, Faiz Za­man Khan and fa­cil­i­ta­tors of Army Pub­lic School at­tack Taj Muham­mad and Ateeq-ur-Rehman.

Mean­while the Supreme Court has sum­moned the records of Mil­i­tary Court judg­ments till next Monday for death row con­victs Jameel-ur-Rehman, As­lam Khan, Taj Gul, Nasir Khan and Qari Zubair. Top Court di­rected that lawyers of the ac­cused should be given ac­cess to the record of th­ese five cases in At­tor­ney Gen­eral Of­fice in pres­ence of mil­i­tary of­fi­cers. Renowned lawyer Asma Je­hangir, Ab­dul Latif Afridi, Colonel re­tired Muham­mad Ikram had chal­lenged the Pe­shawar High Court ver­dicts who had up­held the Mil­i­tary Court judg­ment.

SC was in­formed by the Ad­di­tional At­tor­ney Gen­eral that record of 11 cases out of 17 has been pre­sented in the Court. Dur­ing the course of hear­ing Asma Je­hangir ar­gued that Mil­i­tary Courts rul­ings in th­ese cases is con­trary to the sec­tion 81, 87 of the Pak­istan Army Act and vi­o­la­tion of the Ar­ti­cle 10-A of the con­sti­tu­tion..
