Govt no­ti­fies re­moval of IHC judge Shaukat Aziz

IS­LAM­ABAD: Min­istry of Law and Jus­tice on Thurs­day is­sued no­ti­fi­ca­tion of re­moval of Is­lam­abad High Court (IHC) Judge Shuakat Aziz Sid­di­uqi in pur­suance of Supreme Ju­di­cial Coun­cil rec­om­men­da­tion which led Pres­i­dent of Pak­istan for re­moval of Sid­diqui form the post of the Judge who was in­ca­pable of per­form­ing du­ties of his of­fice while de­clared guilty of mis­con­duct.

On Oc­to­ber 11, Supreme Ju­di­cial Coun­cil rec­om­mended the re­moval of the IHC Jus­tice Shaukat Aziz Sid­diqui on the grounds of mis­con­duct un­der Ar­ti­cle 209 (6) of the Con­sti­tu­tion of Pak­istan.

Coun­cil said in its opin­ion, "This Coun­cil is unan­i­mously of the opin­ion that in the mat­ter of mak­ing his speech be­fore the District Bar As­so­ci­a­tion Rawalpindi on July 21, 2018 Jus­tice Shaukat Aziz Sid­diqui, Judge Is­lam­abad High Court had dis­played con­duct un­be­com­ing of a Judge of a High Court and was, thus, guilty of mis­con­duct and he is there­fore, li­able to be re­moved from his of­fice un­der Ar­ti­cle 206(6) of the Con­sti­tu­tion of the Is­lamic Repub­lic of Pak­istan, 1973."

Un­der the Ar­ti­cle 209 (6) the Coun­cil will send its opin­ion to Pres­i­dent of Pak­istan for re­moval of a Judge of High Court who in­ca­pable of per­form­ing du­ties of his of­fice or has been guilty of mis­con­duct. Af­ter re­ceiv­ing opin­ion of the Coun­cil, the Pres­i­dent of Pak­istan will re­move the guilty Judge from his of­fice.
