EX­PRO­PRI­A­TION - con­se­quen­tial dam­ages for owner

As a gen­eral rule, just com­pen­sa­tion, to which the owner of the prop­erty to be ex­pro­pri­ated is en­ti­tled, is equiv­a­lent to the mar­ket value of the prop­erty ac­tu­ally taken. How­ever, where only a part of the prop­erty is ex­pro­pri­ated, the owner is not re­stricted to com­pen­sa­tion for the portion ac­tu­ally taken; he is also en­ti­tled to re­cover the con­se­quen­tial dam­age, if any, to the re­main­ing (dan­gling) part of the prop­erty.
