A FRIEND PUSHED ME INTO THE POOL AS A PRANK AND NOW MY EXPENSIVE WATCH IS DAMAGED. CAN I TAKE LEGAL ACTION?
Yes, you may be able to take legal action if your friend pushed you into the pool as a prank resulting in damage to your expensive watch. If you can show that your friend knew that pushing you into the pool would cause, for example, water damage to your watch, and your watch stops functioning and/or its value has dropped due to the water damage, you can make a claim against him for mischief. It also does not matter whether your friend had intended to damage your watch. Regardless of your friend’s protests that “it was just a prank”, he has committed an act of mischief. Lastly, if you find that the damage caused has resulted in repairs which cost $500 or more, your friend may be punished with a jail term of up to 2 years and/or a fine.
