A FRIEND PUSHED ME INTO THE POOL AS A PRANK AND NOW MY EX­PEN­SIVE WATCH IS DAM­AGED. CAN I TAKE LE­GAL AC­TION?

Yes, you may be able to take le­gal ac­tion if your friend pushed you into the pool as a prank re­sult­ing in dam­age to your ex­pen­sive watch. If you can show that your friend knew that push­ing you into the pool would cause, for ex­am­ple, wa­ter dam­age to your watch, and your watch stops func­tion­ing and/or its value has dropped due to the wa­ter dam­age, you can make a claim against him for mis­chief. It also does not mat­ter whether your friend had in­tended to dam­age your watch. Re­gard­less of your friend’s protests that “it was just a prank”, he has com­mit­ted an act of mis­chief. Lastly, if you find that the dam­age caused has re­sulted in re­pairs which cost $500 or more, your friend may be pun­ished with a jail term of up to 2 years and/or a fine.
