po­ten­tial le­gal ac­tion is to grasp the Reg­u­la­tions for Ad­mis­sion of Learn­ers to Pub­lic Schools, 2012.

Reg­u­la­tion 5 re­quires all schools to dis­trib­ute ap­pli­ca­tion forms for ad­mis­sions only dur­ing the ap­pli­ca­tion pe­riod and al­lows par­ents time to study and com­plete the ap­pli­ca­tion form be­fore sub­mis­sion. On sub­mis­sion of an ap­pli­ca­tion form, schools are re­quired to give par­ents a wait­ing list num­ber in writ­ing. Within 14 days of the end of the ap­pli­ca­tion pe­riod, schools are re­quired to iden­tify suc­cess­ful and un­suc­cess­ful ap­pli­cants and to have the re­spec­tive wait­ing lists ap­proved by the district di­rec­tor.

Once the wait­ing lists are ap­proved schools are re­quired to in­form par­ents in writ­ing of their suc­cess or not. Schools are re­quired to in­form suc­cess­ful ap­pli­cants they have seven days to con­firm ac­cep­tance and un­suc­cess­ful ap­pli­cants of the rea­sons for not be­ing suc­cess­ful and their right to ob­ject and ap­peal.

This reg­u­la­tion fur­ther places the re­spon­si­bil­ity on the district di­rec­tor first to en­sure that pupils that haven’t been placed within 30 days of the end of the ad­mis­sion pe­riod to place those pupils within the district and there­after places the re­spon­si­bil­ity of plac­ing un­placed pupils in the prov­ince on the head of de­part­ment within 45 days of the end of the ad­mis­sions pe­riod.

This reg­u­la­tion fur­ther al­lows the head of de­part­ment to grant per­mis­sion to a board­ing school to ad­mit a fixed num­ber of pupils who may oth­er­wise not be granted ad­mis­sion to the school.

Schools with board­ing fa­cil­i­ties are pro­hib­ited from ad­mit­ting pupils to board­ing fa­cil­i­ties with­out first grant­ing pupils’ ad­mis­sions to schools. This reg­u­la­tion fur­ther places the re­spon­si­bil­ity on the dis­tricts to place pupils 16 years or older and who have never at­tended school at an adult ed­u­ca­tion and train­ing cen­tre.

Reg­u­la­tion 6 stip­u­lates the doc­u­ments nec­es­sary for ad­mis­sions as an en­try phase learner. Schools are re­quired to use only the stip­u­lated doc­u­ments for the pur­pose of ad­mis­sions. This reg­u­la­tion fur­ther re­quires schools to pro­vide pro­vi­sional ad­mis-
