LE­GAL ACA­DEMICS AGREE it’s un­likely that the Con­sti­tu­tional Court will grant for­mer Pres­i­dent Thabo Mbeki his ap­pli­ca­tion to join the NPA’s ap­peal process. How­ever, opin­ions dif­fer as to whether he’ll suc­ceed in get­ting re­lief on any of the pro­nounce­ments made by Ni­chol­son re­gard­ing his po­lit­i­cal in­ter­fer­ence in the NPA’s work and de­ci­sions. The dif­fer­ence of opin­ion hinges on whether some­one can in­deed ap­peal the sub­stance of a judg­ment or whether an ap­peal has to speak to the rul­ing it­self – which, in this case, was that the NPA fol­lowed in­cor­rect pro­ce­dures. Ul­ti­mately, this may well be an op­por­tu­nity for Mbeki to place his ver­sion of events on record.
