AND MBEKI’S APPLICATION TO THE CONSTITUTIONAL COURT?
LEGAL ACADEMICS AGREE it’s unlikely that the Constitutional Court will grant former President Thabo Mbeki his application to join the NPA’s appeal process. However, opinions differ as to whether he’ll succeed in getting relief on any of the pronouncements made by Nicholson regarding his political interference in the NPA’s work and decisions. The difference of opinion hinges on whether someone can indeed appeal the substance of a judgment or whether an appeal has to speak to the ruling itself – which, in this case, was that the NPA followed incorrect procedures. Ultimately, this may well be an opportunity for Mbeki to place his version of events on record.
