Via email IN NOVEM­BER 2008 I up­graded my cell­phone to a Nokia 5000, for which I had to pay a R239 join­ing-up fee. Since my sub­scrip­tion would fall to R99/month I con­sid­ered it a bar­gain. I re­ceived my phone and, ac­cord­ing to the lo­cal Nashua of­fice, I was on the new con­tract from 1 De­cem­ber 2008.

I now dis­cover that Nashua loaded my con­tract but never ac­ti­vated it. I’m hav­ing prob­lems get­ting its head of­fice to credit me from De­cem­ber 2008. They say it’s MTN’s fault – but it’s Nashua who broke the con­tract, not MTN. How would MTN know about me if Nashua didn’t in­form them?

It looks as if I’ll have to teach them about con­tract law.
