While Fried­man says that she knows of no black mar­ket for fer­til­ity treat­ment in the coun­try, she does how­ever cau­tion her clients against do­ing deals with sur­ro­gate moth­ers via the back­door with large sums of money ex­chang­ing hands.

“I al­ways warn them [my clients], to be care­ful of this as it puts her [the sur­ro­gate mother] in a pow­er­ful po­si­tion where she can use this against you and ex­tort more money from you. If you step out of line and don’t give her what she wants, she’s armed with a nice doc­u­ment that she can use to lead to your pros­e­cu­tion,” says Fried­man. “Ev­ery one of my cou­ples that come to me is pretty fear­ful about the crim­i­nal penalty hang­ing over their heads.” buhlen@fin­week.co.za
