The Pre­to­ria High Court’s rul­ing that gov­ern­ment will not be al­lowed to ap­peal the court rul­ing that it acted un­con­sti­tu­tion­ally when it failed to ar­rest Su­danese Pres­i­dent Omar al-Bashir, sends a clear mes­sage that gov­ern­ment is not above the rule of law. SA author­i­ties will also need to an­swer to the In­ter­na­tional Crim­i­nal Court (ICC), which had is­sued a war­rant of ar­rest for al-Bashir to stand trial on charges of war crimes and geno­cide, ac­cord­ing to Reuters. As a mem­ber of the ICC, SA was obliged to en­force such war­rants. The ICC wants SA to ex­plain its fail­ure to do so by 5 Oc­to­ber.
