ANC threat­ens court ac­tion

THE ANC has threat­ened to take Jo­han­nes­burg city Coun­cil speaker Vasco Da Gama to court if he fails to sched­ule a no­con­fi­dence mo­tion against him­self and mayor Her­man Mashaba at the next coun­cil meet­ing.

Ac­cord­ing to a let­ter, seen by The New Age, from the Jo­han­nes­burg ANC’s le­gal rep­re­sen­ta­tives, Da Gama was given an ultimatum, which lapsed yes­ter­day, to sched­ule the mo­tions on the agenda of the coun­cil meet­ing on Septem­ber 27. The ANC ac­cused the city of ob­struc­tion­ist tac­tics by re­ject­ing an ear­lier re­quest for a se­cret bal­lot in the mo­tion.

“Should we not re­ceive a writ­ten un­der­tak­ing from your­self by close of busi­ness to­mor­row, our in­struc­tion is to ap­proach the High Court on an ur­gent ba­sis to com­pel, among other, to place th­ese two mo­tions on coun­cil agenda for de­bate,” the let­ter said.

The let­ter fur­ther said the city’s de­ci­sion to re­ject the mo­tions against Da Gama and Mashaba were with­out merit.

“You had no le­gal ba­sis to refuse to place the mo­tions of such crit­i­cal im­por­tance and huge pub­lic in­ter­est on the agenda for the coun­cil meet­ing com­menc­ing on the Septem­ber 27.”

This comes as the city of Jo­han­nes­burg’s pro­gramme com­mit­tee re­cently said a se­cret bal­lot was in con­flict with the stand­ing rules of coun­cil.

ANC re­gional spokesper­son Jolidee Ma­tongo said the ANC sought le­gal ad­vice on the mo­tion but the party had yet to hear from Da Gama.

“We’ll wait un­til the morn­ing to see what they have said,” Ma­tongo said.

Mashaba’s spokesper­son Luyanda Mfeka also con­firmed that the city re­ceived the let­ter but said its le­gal rep­re­sen­ta­tives were still ap­ply­ing their minds to it.

“The city has re­ceived the let­ter and will re­spond to its con­tents through our le­gal rep­re­sen­ta­tives,” Mfeka said.

Mfeka said the ANC had no le­gal leg to stand on on the mat­ter.

“It is our be­lief that sev­eral of the al­le­ga­tions con­tained within the let­ter are with­out truth and fail to take into cog­ni­sance sev­eral fac­tors such as the stand­ing rules of coun­cil.”
