LAW en­force­ment au­thor­i­ties again swooped on the Gupta fam­ily prop­erty in Sax­on­wold yes­ter­day, af­ter the Na­tional Pros­e­cut­ing Au­thor­ity (NPA) ob­tained an or­der from the Bloem­fontein High Court to seize as­sets be­long­ing to sev­eral peo­ple and en­ti­ties linked to the funds meant for emerg­ing black farm­ers in the Estina farm project in Vrede, Free State.

This raid is the third this year, the first in Fe­bru­ary at the same res­i­dence, when the Hawks con­firmed that they were ex­e­cut­ing war­rants of ar­rests re­lat­ing to the project. Five peo­ple were ar­rested. In March an­other raid hap­pened at Sa­hara­pur, In­dia.

NPA spokesper­son Lu­vuyo Mfaku said the As­set For­fei­ture Unit ob­tained an or­der on April 11 last year re­lat­ing to the Vrede dairy project.

Mfaku said the raid was led by the cu­ra­tor, in­ves­ti­ga­tors from the As­set For­fei­ture Unit and the Hawks and was aimed at com­pil­ing a list of all the as­sets and value them.

He con­firmed that among the as­sets form­ing part of the re­straint or­der, in­clude im­mov­able prop­erty (res­i­den­tial and busi­ness premises and farms), two air­craft, a he­li­copter, ve­hi­cles and bank ac­counts be­long­ing to cer­tain en­ti­ties, namely Oak­bay In­vest­ments, Is­land­site In­vest­ments 180, Con­fi­dents Con­cept, Sa­hara Com­puter, West­dawn In­vest­ments and Aero­haven Trad­ing. Mfaku said the or­der was a re­sult of on­go­ing crim­i­nal in­ves­ti­ga­tions by the Hawks (DPCI) which led to the ar­rest and in­sti­tu­tion of crim­i­nal prose­cu­tions against the afore­said en­ti­ties and in­di­vid­u­als.

“The or­der makes pro­vi­sion for the re­straint of sev­eral as­sets to the value of R250.2m pend­ing the fi­nal­i­sa­tion of the crim­i­nal trial.

“Upon con­vic­tion the AFU will ap­ply for a con­fis­ca­tion or­der for the re­cov­ery of the said amount and/or any re­lated amounts,” Mfaku said.

“The ac­tion is part of on­go­ing crim­i­nal in­ves­ti­ga­tions by the NPA and DPCI jointly work­ing with other law en­force­ment agen­cies in ad­dress­ing fraud and cor­rup­tion, more specif­i­cally cor­rup­tion in the pri­vate sec­tor and en­sur­ing the re­cov­ery of any gov­ern­ment losses.”
