No bail for rape suspect
AN Ezibeleni man accused of raping an eight-year-old family friend has been denied bail by the Ezibeleni Magistrate’s Court with magistrate Xolisa Ngwendu saying his release was not in the best interests of justice.
Ngwendu considered that the 32-year-old suspect had no previous convictions and that the preliminary results did not link him to the alleged crime.
The accused is said to have been with the boyfriend of the mother of three children, one of whom is the rape victim.
He allegedly had a squabble with the boyfriend prior to the alleged rape.
Ngwendu said it was obvious that the children lived in an environment where there was drinking and partying.
The mother of the child, who can not be named because of the nature of the crime, allegedly accompanied the accused to the police station to report the matter.
The two younger children, aged five and six, are said to have witnessed the incident with the claim that the eight-year-old was raped twice.
Ngwendu said the witnesses were known to the accused and could easily be influenced and that they were not safe, even with their mother.
She denied bail and the matter will go to court again on October 27 for a regional court date.
