No bail for rape sus­pect

AN Ez­i­be­leni man ac­cused of rap­ing an eight-year-old fam­ily friend has been de­nied bail by the Ez­i­be­leni Mag­is­trate’s Court with mag­is­trate Xolisa Ng­wendu say­ing his re­lease was not in the best in­ter­ests of jus­tice.

Ng­wendu con­sid­ered that the 32-year-old sus­pect had no pre­vi­ous con­vic­tions and that the pre­lim­i­nary re­sults did not link him to the al­leged crime.

The ac­cused is said to have been with the boyfriend of the mother of three chil­dren, one of whom is the rape vic­tim.

He al­legedly had a squab­ble with the boyfriend prior to the al­leged rape.

Ng­wendu said it was ob­vi­ous that the chil­dren lived in an en­vi­ron­ment where there was drink­ing and par­ty­ing.

The mother of the child, who can not be named be­cause of the na­ture of the crime, al­legedly ac­com­pa­nied the ac­cused to the po­lice sta­tion to re­port the mat­ter.

The two younger chil­dren, aged five and six, are said to have wit­nessed the in­ci­dent with the claim that the eight-year-old was raped twice.

Ng­wendu said the wit­nesses were known to the ac­cused and could eas­ily be in­flu­enced and that they were not safe, even with their mother.

She de­nied bail and the mat­ter will go to court again on Oc­to­ber 27 for a re­gional court date.
