UDM con­tin­ues MM fight

THE UDM in the Enoch Mgi­jima Lo­cal Mu­nic­i­pal­ity is con­tin­u­ing their fight to have the mu­nic­i­pal man­ager post read­ver­tised.

The UDM had halted a coun­cil meet­ing where the ap­point­ment was due to have been made, via an in­terim in­ter­dict on May 25 on the ba­sis that due process – in terms of Reg­u­la­tion 21 of lo­cal gov­ern­ment reg­u­la­tions on the ap­point­ment and con­di­tions of se­nior man­agers – had not been fol­lowed in the ap­point­ment.

Judge NG Beshe how­ever dis­missed the rule nisi (an or­der to show cause) dur­ing a sub­se­quent court ap­pear­ance, in­di­cat­ing that he was not happy that UDM coun­cil­lor Mthuthuzeli Hoko was au­tho­rised to bring the ap­pli­ca­tion on be­half of the ap­pli­cant.

Hokolo said at the time UDM had is­sued a no­tice of in­tent to ap­peal to the court.

In a tele­phone in­ter­view this week, Hokolo said the ap­peal would still con­tinue and that he had since ob­tained a let­ter from the UDM na­tional ex­ec­u­tive com­mit­tee (NEC) on the man­date to pur­sue the mat­ter.

He said op­po­si­tion par­ties had also voted against the ap­point­ment of a new MM in pre­vi­ous meet­ings “which means they saw that this was il­le­gal”.

The UDM would fight for the po­si­tion to be read­ver­tised and for le­gal pro­cesses to be fol­lowed.

EMLM spokesman Fundile Feket­shana said the mat­ter of the MM’s ap­point­ment was still be­ing dealt with by the coun­cil. All stake­hold­ers would be up­dated once de­ci­sions had been made.
