UDM continues MM fight
THE UDM in the Enoch Mgijima Local Municipality is continuing their fight to have the municipal manager post readvertised.
The UDM had halted a council meeting where the appointment was due to have been made, via an interim interdict on May 25 on the basis that due process – in terms of Regulation 21 of local government regulations on the appointment and conditions of senior managers – had not been followed in the appointment.
Judge NG Beshe however dismissed the rule nisi (an order to show cause) during a subsequent court appearance, indicating that he was not happy that UDM councillor Mthuthuzeli Hoko was authorised to bring the application on behalf of the applicant.
Hokolo said at the time UDM had issued a notice of intent to appeal to the court.
In a telephone interview this week, Hokolo said the appeal would still continue and that he had since obtained a letter from the UDM national executive committee (NEC) on the mandate to pursue the matter.
He said opposition parties had also voted against the appointment of a new MM in previous meetings “which means they saw that this was illegal”.
The UDM would fight for the position to be readvertised and for legal processes to be followed.
EMLM spokesman Fundile Feketshana said the matter of the MM’s appointment was still being dealt with by the council. All stakeholders would be updated once decisions had been made.
