Jail for killing mom to get baby
THE Pietermaritzburg High Court yesterday sentenced a woman to 20 years imprisonment for strangling another woman to death so that she could adopt her baby.
Acting Judge Kobus Booyens jailed Nompumelelo Sibiya, 22, of Greytown, who was 17 years old at the time of the crime in 2005.
She miscarried when she was six months pregnant and feared that her boyfriend, Joseph Mthethwa, would no longer marry her.
Her cousin, known only as Sibusiso, suggested she kill a distant relative, Lucia Mtshali, who was 18 at the time and who had a baby.
This was so that Sibiya could take the baby and pretend it was her own.
Sibiya and Sibusiso then persuaded Mtshali to accompany them into a forestwhere they strangled her.
Sibiya then fled to Durban and later handed herself over to the police. She confessed to the murder and pointed out the body.
Booyens said her actions had been driven by such a desperate love for Mthethwa that she committed the evil deed.
But the circumstances were so exceptional, they justified a departure from the prescribed sentence of life in jail, said Booyens.
