18 years RI for accused who clubbed to death his wife
An accused who stood indicted with murder was found guilty of culpable homicide not amounting to murder and sentenced to 18 year rigorous imprisonment and fined Rs.2,500 by Chilaw High Court Judge MS.Y. Fernando after trial by jury.
The accused C.C. Ruwan Kumara (32) of Waikkala was the father of two children and a barber by profession. He had on December 13, 2013 clubbed to death his wife Manorackshi Fernando (31) during an altercation over a family dispute. He was tried before a seven member jury after he pleaded not guilty.
Investigations had revealed that his wife’s secret relations with a young man with whom she had been in love before her marriage had resulted in a family dispute. The suspect who loved his wife much had warned her repeatedly to give up her clandestine relations with her lover. However on the day of the incident she had given a telephone call to her lover at the dead of night while the accused was asleep. The accused, who woke up had an altercation with her and assaulted her with a club.
The jury were divided in opinion and by verdict of six to one the accused was sentenced to culpable homicide not amounting to murder.
State Counsel Padmalal Weerasinghe De Silva prosecuted while Attorney-at-law Samantha Fernando appeared for the accused. Attorneys-at- Law Tharanga Dissanayake and Landekumbura watched the interests of the deceased.
