18 years RI for ac­cused who clubbed to death his wife

An ac­cused who stood in­dicted with mur­der was found guilty of cul­pa­ble homi­cide not amount­ing to mur­der and sen­tenced to 18 year rig­or­ous im­pris­on­ment and fined Rs.2,500 by Chi­law High Court Judge MS.Y. Fer­nando af­ter trial by jury.

The ac­cused C.C. Ruwan Ku­mara (32) of Waikkala was the father of two chil­dren and a bar­ber by pro­fes­sion. He had on De­cem­ber 13, 2013 clubbed to death his wife Manorack­shi Fer­nando (31) dur­ing an al­ter­ca­tion over a fam­ily dis­pute. He was tried be­fore a seven mem­ber jury af­ter he pleaded not guilty.

In­ves­ti­ga­tions had re­vealed that his wife’s se­cret re­la­tions with a young man with whom she had been in love be­fore her mar­riage had re­sulted in a fam­ily dis­pute. The sus­pect who loved his wife much had warned her re­peat­edly to give up her clan­des­tine re­la­tions with her lover. How­ever on the day of the in­ci­dent she had given a tele­phone call to her lover at the dead of night while the ac­cused was asleep. The ac­cused, who woke up had an al­ter­ca­tion with her and as­saulted her with a club.

The jury were di­vided in opin­ion and by verdict of six to one the ac­cused was sen­tenced to cul­pa­ble homi­cide not amount­ing to mur­der.

State Coun­sel Pad­malal Weeras­inghe De Silva pros­e­cuted while At­tor­ney-at-law Samantha Fer­nando ap­peared for the ac­cused. At­tor­neys-at- Law Tha­ranga Dis­sanayake and Lan­dekum­bura watched the in­ter­ests of the de­ceased.
